Proposed Amendments to Zoning By-laws 2009 - Public Hearing April 15, 2009

 

WESTPORT PLANNING BOARD

 

The Westport Planning Board will hold a public hearing on Wednesday, April 15, 2009 at 7:00 p.m. at the Town Hall Annex, 856 Main Road to consider the following proposed amendments to the Westport Zoning Bylaws:

 

1)      To add Article 19- Noquochoke Overlay District to create a Noquochoke Overlay District  (NOD) consisting of the following parcels: Assessor’s Map 33, Lots 17, 45, 47, 47A & 47E by amending the Westport Zoning Bylaws as follows:

a)      By amending Section 1.1 Definitions.    

b)      By amending Section 2.6 to designate the Planning Board as the Special Permit Granting Authority for the Noquochoke Overlay District and incorporating the language from Section 2.7 into Section 2.6.

c)      By deleting Section 2.7 in its entirety.

d)      By amending Article 3 Establishment of Districts by adding “H. Noquochoke Overlay District”.

e)      By amending Section 3.1 Location of Districts to describe the location of the Noquochoke Overlay District.

f)        By amending Article 4.0 Use Regulations by adding Section “4.0.8 Noquochoke Overlay District (NOD) See Article 19.”

 

2)      To accept the provisions of G.L.c.44,s.55C establishing a trust to be known as the Westport Affordable Housing Trust Fund and to amend the General By-laws of the Town of Westport by inserting Article LVI “Westport Affordable Housing Trust Fund.”

 

3)      To amend Article 8 Aquifer Protection District of the Westport Zoning By-laws Section 8.3.2 to allow decentralized innovative alternative sewage treatment systems as approved by the Board of Health.

 

4)      To amend Article 6.0 Flood Plain Districts by replacing existing Article 6 of the Westport Zoning By-Laws with language as required by Federal Emergency Management Agency to be in compliance with Title 44, Chapter 1, Part 67, Code of Federal Regulation and to amend Section 3.1.D Flood Plain District.

 

A copy of the proposed text and maps are on file with the Town Clerk’s office, Town Hall, and may be inspected there during regular business hours.
